Today (13 Feb) at the headquarters of the Thai Sang Thai Party, Khunying Sudarat Keyuraphan, former leader of the Thai Sang Thai Party, stated that she is preparing to take legal action against the Election Commission (EC) after the EC admitted that the barcode and QR code system on ballots can be scanned and traced back to the original ballot stub to identify which voter voted for which political party or candidate. She argues that this constitutes a deliberate violation of the fundamental principle of election secrecy. The EC's claim that ballots and stubs were separated and kept confidential is deemed unacceptable and fails to build public trust. Given the rife irregularities and fraud in the recent election, with the perpetrators yet to be apprehended.
The legal proceedings will be divided into two main parts to achieve the maximum legal outcome. The first part focuses on holding individuals accountable. A lawsuit will be filed against the Election Commission (EC) in the Central Criminal Court for corruption and malfeasance, under Section 157 of the Criminal Code, for official misconduct causing harm to others, or for fraudulent conduct, which carries a severe penalty, including imprisonment. The EC was well aware that including identifying codes on ballots was a clear violation of the law and the Constitution.
The second part aims to restore justice for the people's votes. Petitions will be filed with the Constitutional Court and the Supreme Court's Election Division to highlight that this election violated Section 85 of the Constitution and Section 96 of the Act on the Election of Members of the House of Representatives, which protect the rights and secrecy of voters. This will lead to an order for a new election that is more transparent and fair. Simultaneously, the public and all stakeholders are invited to submit information, evidence, photographs, or video clips demonstrating any irregularities in this election. Please visit Khunying Sudarat's page or the Thai Sang Thai Party page to use this as evidence in legal proceedings and to join us in reclaiming the sovereignty that has been distorted.
