On November 25, 2025, the ConforAll , along with the Assembly of the Poor, submitted a letter to the Prime Minister and the Cabinet, urging them to immediately hold a referendum on a new constitution. The Cabinet has the authority to make decisions on any matter it deems appropriate.

According to ConforAll, the Cabinet, formed under the MoA (Movement of Action) between the Bhumjaithai Party and the People's Party, agreed to dissolve Parliament within four months and hold a new election on March 29, 2026, which would include a referendum on a new constitution. With the government in a minority, there is concern that Parliament could be dissolved at any time. If Parliament is dissolved before the referendum, the period of 60-150 days specified in Section 11 of the Referendum Act B.E. 2021 (Referendum Act) would be exceeded. This would prevent the referendum from taking place on time, and the government would fail to fulfill its pledges to the people.

In 2023, ConforAll collected more than 200,000 signatures on a petition asking, "Do you agree that Parliament must amend the 2017 Constitution to draft a new constitution entirely, with members of the Constitution Drafting Assembly (CDA) elected by the people?" However, this petition has never been considered by any cabinet. As a result, the current cabinet is asked to review the recommendations previously submitted by the public.

The two topics are:

1. A new constitution.

2. A CDA that is 100% elected.

ConforAll added that the referendum on Question 1 is covered by Section 9 (2) of the Referendum Act. If the Cabinet judges it appropriate, the referendum can be voted on immediately. There is no need to wait until Parliament considers the constitutional revision. To provide certainty and public trust that a referendum on at least one question will be held within the timeframe specified in the MOA, this Cabinet must promptly expedite the Cabinet's resolve to hold a referendum concurrent with the next election.

Hence, if the Cabinet decides today to execute the reported agreement, it will reassure the public that they will have the opportunity to vote on a new constitution. This government will be praised for its "Bravery" in proposing a political solution. However, if the referendum does not take place by the deadline, this government will be remembered as a "Reneging Party"

Mr. Paradorn Prissananantakul, Minister to the Prime Minister's Office, who represented the government in the submission of a petition, announced that the government plans to seek a referendum today (November 25, 2025). Some legal issues may arise after examining the Constitutional Court's verdict. As such, the legal team is looking into whether this can be done, as the administration plans to hold the first referendum on March 29, 2026, despite the fact that the House of Representatives will be dissolved on January 31, 2026. Mr. Paradorn stated that regardless of whether the alteration of Section 256 of the Constitution to allow for the drafting of a new constitution is accidental, the referendum and election are certain to take place.

Mr. Siripong Angkasakulkiat The Prime Minister's Office spokeswoman noted that the Cabinet aims to follow the MOA, except in circumstances where a majority is obtained, which would contravene Article 4 of the MOA, which requires no more than half of the votes, perhaps leading to a (political) accident. Siripong announced that a decision on the date and time of the referendum will be made within the next week (at the December 2, 2025 Cabinet meeting).

Political uncertainty threatens to derail the MOA and referendum, but success would pave the way for a people’s constitution

SAP NEWs

talked with Mr. Yingcheep Atchanon, a representative from ConforAll. He stated that the current political scenario is unpredictable, and that the MOA is likely to be postponed ending in no referendum. This would be deemed a failure by this government. However, if a referendum is held amidst all of this volatility, the constitution will be deemed a success and ratified, paving the door for a people's constitution in the future.

SAP NEWs

However, due to political uncertainty, it is unknown when the second and third readings of the constitutional amendments would be completed. He believes there is no reason to wait. The Cabinet may then issue a referendum resolution. The first question is,"Do you agree to drafting a new constitution?"Because we will know that if the parliament is dissolved, the people will have at least one referendum and election.

Cabinet approves royal decree for Dec 10-11 ordinary session as push to amend constitution up before this year

On November 25, 2025, at Government House, Siripong Angkasakulkiat, Spokesperson, revealed the results of the Cabinet meeting in order to hold the second and third readings of the constitutional change, the Cabinet authorized the draft Royal Decree calling an extraordinary session of Parliament for December 10–11, 2025.

SAP NEWs

According to the Constitution, there must be a 15-day wait following the second reading before the third reading is taken into consideration. However, the constitutional amendment procedure would not be finished in the allotted time if the bill were to be discussed during the normal session on December 12. In order to enable Parliament to finish the constitutional change process within the time limit established, a request was made to call an extraordinary session.

However, Sangsiri Trimarkha, Secretary-General NGO Coordinating Committee On Development   (NGO COD) , said that the NGOs will hold a "Walk to the Future" event from December 6-10, 2025, to promote a referendum on a new Constitution. The walk will begin in Wang Noi District, Phra Nakhon Si Ayutthaya Province and go over 60 kilometers in five days. She invites the public to get involved in this activity and call for a referendum.
